Refund And Cancellation Policy

This Policy applies to orders placed directly with HOGGS Gourmet Grill through its website, by telephone, or at the restaurant. Orders placed through an independent delivery or ordering platform may also be governed by that platform’s policies. Nothing in this Policy limits any right or remedy that cannot lawfully be waived.

1. Purpose and scope

HOGGS Gourmet Grill wants customers to receive the food and service they ordered. This Policy explains when an order may be changed or canceled, how concerns are reviewed, what remedies may be available, and how refunds are processed.

This Policy covers individual restaurant orders, pickup orders, direct delivery orders if offered, online orders, catering inquiries and confirmed catering orders, gift cards where applicable, and promotional purchases. It should be read together with the website Terms and Conditions and Privacy Policy.

2. General principles

Because restaurant food is perishable and may be prepared immediately after an order is accepted, food orders generally cannot be returned in the same manner as ordinary retail merchandise. A refund is not automatically available because a customer changes their mind, dislikes a correctly prepared item, arrives late, orders the wrong item, or fails to collect an order.

HOGGS will review legitimate concerns fairly and may provide a correction, replacement, store credit, partial refund, full refund, or another reasonable resolution depending on the facts, the amount affected, the condition of the food, and applicable law. Any remedy described in this Policy is subject to verification of the order and may be limited to the affected item or affected portion of the order unless the entire order was materially affected.

3. Review the order before submitting it

Customers are responsible for reviewing the order before payment, including the restaurant location, pickup or delivery method, requested time, menu items, quantities, sides, sauces, modifications, allergy notes, contact information, delivery address, and payment total.

HOGGS is not required to refund an order because the customer selected the wrong item, quantity, side, location, date, time, address, or customization. HOGGS may nevertheless assist when reason

4. When an order becomes final

An online confirmation means that the order request was received. HOGGS may still contact the customer about availability, substitutions, payment issues, operational limitations, or an apparent error. An order becomes operationally committed when HOGGS accepts the order and begins preparation, allocates food, schedules staff, orders supplies, or otherwise incurs costs in reliance on the order. Once an order is operationally committed, cancellation or modification may no longer be possible.

5. How to request a change or cancellation

To request a change or cancellation, contact HOGGS immediately using the telephone number or contact method shown on the website or order confirmation. Sending a message does not guarantee that it will be seen before preparation begins.

A request should include:

  • The customer’s name and telephone number.
  • The order number, if available.
  • The date and approximate time of the order.
  • The requested change or reason for cancellation.
  • The ordering method, such as the HOGGS website, telephone, in person, or third party platform.

HOGGS will make reasonable efforts to honor a timely request, but approval is not guaranteed.

6. Standard food order cancellations

Before preparation begins: HOGGS may approve a full cancellation and refund to the original payment method.

After preparation begins: HOGGS may deny the cancellation or may deduct the value of food, labor, packaging, processing charges, and other costs already incurred. After an order is completed, picked up, transferred to a delivery provider, or delivered: the order ordinarily cannot be canceled. Any concern will be handled under the incorrect, missing, damaged, or quality concern sections of this Policy.

7. Order modifications

Requested modifications are not effective unless HOGGS confirms them. Additional charges may apply. If a requested modification cannot be accommodated, the original accepted order remains in effect unless HOGGS agrees to cancel or replace the affected item.

Modifications involving allergies or dietary restrictions must be communicated directly and clearly. HOGGS cannot guarantee an allergen free environment or eliminate the risk of cross contact.

8. Restaurant initiated cancellations

HOGGS may cancel all or part of an order because of an unavailable item, equipment failure, power interruption, unsafe conditions, payment failure, suspected fraud, severe weather, staffing limitations, closure, pricing error, technical malfunction, or another reasonable operational or safety concern.

When HOGGS cancels an item or order before fulfillment, HOGGS will ordinarily provide a refund for the canceled amount or offer a reasonable substitution with the customer’s approval. HOGGS is not responsible for indirect losses, travel costs, missed events, or other consequential expenses to the extent permitted by law.

9. Incorrect orders

If HOGGS provides a materially different item from the item confirmed on the order, the customer should contact HOGGS promptly. HOGGS may request that the item be retained and returned to the restaurant, when safe and practical, or photographed for verification. Depending on the circumstances, HOGGS may remake the item, replace it, provide a credit, or refund the price paid for the affected item. Minor variations in presentation, size, color, seasoning, arrangement, or appearance do not necessarily make an order incorrect.

10. Missing items

Customers should check pickup orders before leaving whenever practical. A missing item should be reported as soon as reasonably possible, preferably on the same day and no later than 24 hours after the scheduled pickup or delivery time.

After confirming the purchase, HOGGS may provide the missing item, a substitute accepted by the customer, store credit, or a refund for the missing item. HOGGS is not required to refund unaffected items.

11. Food quality concerns

Food quality concerns should be reported promptly, preferably within two hours after pickup or delivery and no later than 24 hours after the scheduled fulfillment time. Prompt notice helps HOGGS investigate preparation, holding time, transport, and food safety conditions.

A customer may be asked to provide photographs, preserve the remaining food and packaging, describe how the food was transported and stored, and identify when it was first consumed.

HOGGS may decline a refund when the concern results from delayed pickup, delayed consumption, customer transportation, improper storage, reheating, customer modification, failure to follow food safety instructions, normal personal taste preferences, or substantial consumption of the item without timely notice.

Nothing in this section limits rights relating to food that is unsafe, contaminated, or otherwise not fit for consumption. A customer who believes food caused a serious illness should stop consuming it, preserve relevant information and remaining food when safe to do so, seek appropriate medical care, and contact HOGGS promptly.

12. Temperature concerns and delayed pickup

Food is prepared for consumption within a reasonable period after pickup or delivery. HOGGS is not responsible for temperature or quality deterioration caused by a customer arriving after the quoted pickup window, a customer leaving food unrefrigerated, traffic or travel after pickup, or delay after delivery.

Quoted preparation, pickup, and delivery times are estimates and may change because of order volume, cooking time, staffing, traffic, weather, or circumstances beyond HOGGS’ reasonable control. A reasonable delay by itself does not automatically entitle a customer to a refund.

13. Pickup orders not collected

If a customer does not collect a completed pickup order, HOGGS may hold the order only for a period consistent with food safety and quality. The order may then be discarded. A no show or late pickup does not ordinarily qualify for a refund.

If HOGGS is unable to fulfill the order because the restaurant is closed or made an error concerning the confirmed pickup time, HOGGS will review the matter for an appropriate refund or replacement.

14. Delivery orders placed directly with HOGGS

If HOGGS directly accepts and controls delivery, the customer is responsible for providing a complete and accurate delivery address, access instructions, gate code, unit number, telephone number, and an available recipient.

HOGGS may deny a refund when delivery fails because the address or instructions were inaccurate, the customer could not be reached, access was unavailable, the customer refused a conforming order, or the food was left as instructed.

If a directly controlled delivery is not completed because of an error attributable to HOGGS, HOGGS may redeliver, remake, credit, or refund the affected order.

15. Independent delivery and ordering platforms

Orders placed through an independent platform, such as a delivery marketplace or ordering service, may be processed, charged, delivered, refunded, and supported by that platform. The platform’s terms, refund rules, evidence requirements, and customer service procedures may apply.

Customers should first use the platform’s support process when the platform collected payment or controlled delivery. HOGGS may assist with restaurant preparation issues but may not have authority to issue a platform refund or reverse platform fees, delivery fees, tips, membership charges, or promotional credits.

Nothing in this section prevents a customer from contacting HOGGS about an alleged preparation error or exercising nonwaivable rights against the appropriate responsible party.

16. Catering inquiries and quotations

A catering inquiry, website form, preliminary discussion, or estimate does not create a confirmed catering order. A catering order is confirmed only when HOGGS expressly accepts it and any required deposit or payment is received.

A written catering proposal, invoice, confirmation, or agreement may contain event specific terms governing quantities, menu selections, staffing, equipment, delivery, setup, deposits, final payment, cancellation, and refunds. Those event specific terms control if they conflict with this general Policy.

17. Catering changes and cancellations

Catering orders require advance purchasing, preparation, labor scheduling, and capacity commitments. Customers must request changes or cancellation as early as possible using the contact information on the catering confirmation.

Unless different written terms were provided for the event, HOGGS may determine any catering refund based on the notice provided and costs already incurred. HOGGS may retain or deduct nonrecoverable food costs, special order costs, payment processing fees when lawful, committed labor, delivery preparation, rental expenses, and other reasonable reliance costs.

Cancellations close to the event date, after final quantities are confirmed, after special supplies are ordered, or after preparation begins may be nonrefundable up to the full amount committed. HOGGS may offer rescheduling or credit in its discretion when operationally practical.

If HOGGS cancels a confirmed catering order and cannot provide an agreed substitute or rescheduled service, HOGGS will refund amounts paid for the canceled service. Any additional liability is limited as provided in the applicable catering agreement and law.

18. Deposits and advance payments

A deposit may reserve production capacity, staff, ingredients, equipment, or an event date. The applicable confirmation should state whether the deposit is refundable, partially refundable, or nonrefundable and when the remaining balance is due.

A deposit described as nonrefundable may still be subject to rights that cannot legally be waived and may not permit HOGGS to retain more than allowed under applicable law. HOGGS may apply a retained deposit toward documented preparation and reliance costs or other amounts due under the catering agreement.

19. Large orders and special orders

Large orders, custom menus, special ingredients, holiday orders, whole meat orders, and orders requiring advance purchasing may have separate cancellation deadlines and nonrefundable components. The terms communicated at checkout, on the invoice, or in the written confirmation control.

If no separate terms were communicated, HOGGS will evaluate the request using the timing of cancellation, whether preparation began, whether ingredients can reasonably be reused, and the costs already incurred.

20. Promotions, coupons, discounts, and complimentary items

Refunds are based on the amount actually paid for the affected item after discounts. Promotional value, complimentary items, rewards, loyalty benefits, or coupons generally have no cash value unless required by law.

If a refund causes the remaining transaction to no longer qualify for a promotion, HOGGS may recalculate the transaction and deduct the promotional benefit from the refund where lawful and clearly disclosed.

21. Gift cards and gift certificates

Purchased gift cards and gift certificates are generally not refundable for cash except when required by California law or other applicable law. Beginning April 1, 2026, a California gift card or gift certificate with a remaining cash value of less than $15 is redeemable for cash upon request, subject to statutory exceptions.

Refunds for purchases made with a gift card may be returned to the same gift card, issued as another gift card or store credit, or handled as required by law. Promotional cards provided without payment may have separate conditions and may not be redeemable for cash except where the law requires otherwise. Lost, stolen, damaged, or unauthorized gift cards may be replaced only if HOGGS can verify the card and remaining balance and replacement is allowed by the card system and applicable law.

22. Payment processing and refund timing

Approved refunds will ordinarily be returned to the original payment method. HOGGS may use a different lawful method when the original method is unavailable, the payment platform requires another method, or the parties agree otherwise.

HOGGS will initiate an approved refund within a reasonable time, usually within five business days after approval. The customer’s bank, card issuer, payment processor, or platform may require additional time, commonly five to ten business days or longer, to display the credit. HOGGS does not control the posting schedule of financial institutions or independent platforms.

Original delivery fees, platform fees, processing fees, gratuities, and similar charges may be nonrefundable when retained by an independent provider or already earned, unless the charge resulted from HOGGS’ error or applicable law requires a refund.

23. Cash, debit card, and credit card purchases

Cash refunds require verification of the transaction and may be limited to the amount actually paid. Debit and credit card refunds ordinarily must be returned to the card or account used for the purchase.

This Policy does not restrict a customer’s rights under federal or state payment laws. For example, federal credit card billing error procedures may apply to goods or services not accepted or not delivered as agreed. Customers should first contact HOGGS so the restaurant has a reasonable opportunity to investigate and resolve the concern, but this request does not shorten any legally protected dispute deadline.

24. Chargebacks and payment disputes

A customer should not knowingly submit a false chargeback, duplicate claim, or payment dispute after receiving a refund, replacement, credit, or conforming order. HOGGS may provide order records, confirmations, photographs, communications, delivery evidence, and refund information to a payment processor or card issuer when responding to a dispute. Nothing in this Policy prevents a customer from exercising lawful billing dispute rights. HOGGS may suspend online ordering privileges when it reasonably determines that an account has engaged in fraud, repeated abusive disputes, or material misuse of the refund process.

25. Proof of purchase and verification

HOGGS may request reasonable information needed to verify and investigate a request, including:

  • The order number, receipt, or payment confirmation.
  • The name, telephone number, or email address connected to the order.
  • The date, time, location, and ordering method.
  • A description of the concern and the resolution requested.
  • Photographs of the item, packaging, receipt, or delivery condition when relevant.
  • Return of the affected item when safe, practical, and reasonably requested.
  • HOGGS will use request information for customer service, fraud prevention, recordkeeping, legal compliance, and dispute resolution consistent with its Privacy Policy. 26. Substantial consumption and disposal of food A refund may be denied when the customer substantially consumes or discards an item before reporting an observable issue, unless disposal was reasonably necessary for health or safety. HOGGS recognizes that some concerns cannot be discovered until food is tasted or consumed, and each request will be reviewed based on its facts.

    27. Abuse, fraud, and repeated claims

    HOGGS may deny a request supported by false information, altered evidence, threats, harassment, repeated unsupported claims, attempted double recovery, or other suspected fraud. HOGGS may restrict ordering privileges or refer suspected fraud to a payment provider or appropriate authority.

    A denial under this section does not affect any right that cannot legally be waived and does not authorize discrimination or retaliation against a customer for making a good faith complaint.

    28. How HOGGS may resolve a claim

    After reviewing a request, HOGGS may provide one or more of the following, as appropriate:

    • Correction of the order.
    • Replacement of the affected item.
    • A reasonable substitute accepted by the customer.
    • Store credit.
    • A partial refund limited to the affected item or amount.
    • A full refund when the entire order was materially affected.
    • No refund when the request does not qualify under this Policy or applicable law.

    A courtesy remedy does not constitute an admission of fault, liability, or a continuing obligation to provide the same remedy in another situation.

    29. Customer safety complaints

    Reports involving a foreign object, suspected contamination, allergic reaction, or foodborne illness should be made promptly and should include available order and product information. HOGGS may ask the customer to preserve the food and packaging safely for review and may report or respond to the matter as required by health or safety authorities. This Policy is not medical advice. In a medical emergency, contact emergency services or seek immediate medical care.

    30. Contact method

    Refund, correction, change, and cancellation requests should be submitted to HOGGS Gourmet Grill using the current telephone number, email address, contact form, or restaurant address published on the official website or order confirmation. For the fastest assistance with an active order, telephone contact is recommended. Social media comments and direct messages may not be monitored continuously and should not be relied upon for urgent changes or cancellations.

    31. Policy disclosure and order specific terms

    This Policy should be made reasonably available before or at the time an online order is placed. Additional terms displayed during checkout, on a catering proposal, on a gift card, with a promotion, or on an order confirmation are incorporated into this Policy to the extent they are lawful and do not conflict with nonwaivable rights.

    If an order specific written term directly conflicts with this general Policy, the more specific term controls for that transaction unless prohibited by law.

    32. Changes to this Policy

    HOGGS may update this Policy prospectively to reflect changes in ordering methods, payment providers, delivery services, restaurant operations, customer service practices, or applicable law. The revised Policy will identify a new Last Updated date. The version in effect when an order is placed will ordinarily govern that order, except when a later change is required by law or provides the customer a more favorable remedy.

    33. Severability and nonwaivable rights

    If any part of this Policy is found invalid or unenforceable, that part will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. Nothing in this Policy excludes, limits, or conditions any warranty, refund right, billing dispute right, food safety protection, or other consumer right that cannot lawfully be excluded, limited, or conditioned.

    34. Governing law

    This Policy is governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be handled in the forum and manner provided by the HOGGS Terms and Conditions, subject to applicable law.
